These Terms of Service ("Terms") govern your access to and use of the website viralvolt.ai and any related services, software, or content we provide (collectively, the "Service"), owned and operated by Gantima ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms. Please read Section 18 carefully — it requires most disputes to be resolved by binding arbitration on an individual basis and waives class-action rights.
You must be at least 13 years old to use the Service, or at least 16 years old if you are located in the European Union. By using the Service, you represent that you meet these requirements, that you are able to form a binding contract, and that you have the authority to enter into these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account. If you suspect unauthorized access, notify us immediately at viralvolt-support@gantima.com.
Automatic renewal — please read carefully: Paid Viral Volt plans are subscriptions that renew automatically. Unless you cancel before the end of your current billing period, we will automatically charge your payment method the then-current plan price at the start of each new billing period (monthly or annually, as selected). Prices, plan features, and taxes may change with prior notice; you will always be shown the price and billing cycle before you subscribe and again at checkout.
Free trials: Some plans may include a 7-day free trial for first-time subscribers. If you do not cancel before the trial ends, your card will be charged the applicable plan rate. We will send you an email reminder at least 3 days before your trial ends and before any renewal charge.
How to cancel: You may cancel at any time — with the same number of steps used to sign up — through Account → Billing in your dashboard, or by emailing viralvolt-billing@gantima.com. Cancellation takes effect at the end of your current paid period; you retain access until then.
Refunds: All fees are non-refundable except (i) where required by applicable law or (ii) where we state otherwise in writing. Cancel any time before your 7-day free trial ends to avoid being charged. Plan upgrades take effect immediately; refunds for downgrades, if any, are prorated to your next billing date.
Chargebacks: If you dispute a charge with your card issuer without first contacting us at viralvolt-billing@gantima.com, we may suspend or terminate your account. Fraudulent chargebacks may be referred to collections.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business or personal use, as applicable. We reserve all rights not expressly granted to you.

You retain ownership of the content you submit to the Service. By submitting content, prompts, or materials, you grant us a limited, worldwide, non-exclusive, royalty-free license to process, store, display, and use that content solely to operate, maintain, secure, and improve the Service. This license ends when you delete your content or account, except to the extent copies are required for legal compliance or normal backup rotation.
You are responsible for ensuring that your content does not infringe the rights of others or violate applicable law.
Some features of Viral Volt use third-party AI services, including Google Gemini and Veo 3, to process user prompts and generate outputs. Content you submit may be processed by those providers in accordance with their own policies.
To the extent permitted by applicable law, you may use content you generate through the Service for your own purposes, subject to the terms of the underlying AI providers. You acknowledge that (i) purely AI-generated output may not be eligible for copyright protection in some jurisdictions (including under U.S. Copyright Office guidance), (ii) AI systems can produce inaccurate, biased, or infringing output, and (iii) you are solely responsible for reviewing generated content and ensuring your use of it complies with applicable laws and the policies of platforms such as TikTok, Instagram, YouTube, and X.
We make no warranty that AI output will be accurate, original, or suitable for any particular purpose. We do not use your prompts to train our own models unless we specifically tell you otherwise.
The Service, including its software, design, branding, logos, and all related intellectual property, belongs to Gantima d/b/a Viral Volt or its licensors. Nothing in these Terms transfers ownership of our intellectual property to you.
We respect intellectual property rights. If you believe content generated with, stored on, or accessible through the Service infringes your copyright, send a written notice to our designated agent that includes: (a) an electronic or physical signature of the copyright owner or authorized agent; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material and its location (URL); (d) your contact information (name, address, phone, email); (e) a statement that you have a good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act.

We may remove allegedly infringing content, terminate accounts of repeat infringers, and forward notices to the affected user. Knowingly false claims may result in liability under 17 U.S.C. § 512(f).
The Service can connect to third-party social media platforms (TikTok, Instagram, YouTube, X, etc.) via OAuth. When you connect an account, you authorize us to store your access token, refresh token, basic profile information (username, ID, avatar), and any content or metrics you explicitly ask the Service to read or publish. You can revoke a connection at any time in Account → Connections and, separately, in each platform's own settings. Your use of each platform remains subject to that platform's own terms.
Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and share personal information — including data obtained through third-party platform connections.
We do not guarantee uninterrupted or error-free operation of the Service. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. Events beyond our reasonable control (including force majeure, third-party outages, and government actions) do not constitute a breach of these Terms.
The Service may integrate with third-party services such as Stripe, Amazon Web Services, Google services, analytics providers, and email providers. We are not responsible for third-party services, their content, or their policies.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will meet your expectations or that any output generated by the Service will be accurate, complete, or suitable for every use case. We do not guarantee specific results such as followers, views, sales, or growth. Your success on social media depends on many factors outside our control.
To the maximum extent permitted by law, Viral Volt and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity.
Our total liability for any claim will not exceed the greater of (i) the amount you paid to us in the 12 months before the event giving rise to the claim, or (ii) US$100.
You agree to defend, indemnify, and hold harmless Viral Volt, its affiliates, officers, employees, and agents from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.
You may stop using the Service at any time. You may delete your account at any time. We may suspend or terminate your access if we believe you violated these Terms, engaged in fraud or abuse, created risk or legal exposure for us, or if required by law. Upon termination, your right to use the Service will end immediately. Sections that by their nature should survive termination (including 7, 9, 14, 15, 16, 18) will survive.
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules.
Binding individual arbitration: You and Gantima agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") will be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual action in small-claims court, and either party may seek injunctive or equitable relief in court for infringement of intellectual property.
Class-action waiver: All Disputes must be brought in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.
Opt-out: You may opt out of this arbitration agreement by emailing admin@gantima.com within 30 days of first accepting these Terms with the subject "Arbitration Opt-Out" and your account email. If you opt out, disputes will be resolved in the state or federal courts located in Maryland, and you and we consent to the personal jurisdiction of those courts.
To the extent permitted by law, you waive any right to a jury trial.
We may update these Terms from time to time. If we make material changes, we will provide at least 7 days' notice (by email to your account address or in-app notice) before they take effect. Your continued use of the Service after the effective date means you accept the updated Terms. If you do not accept, you must stop using the Service and may cancel your subscription.
You represent that you are not located in, and are not a national or resident of, any country or region subject to U.S. embargoes or comprehensive sanctions, and that you are not on any U.S. government list of prohibited or restricted parties. You will not use the Service in violation of any U.S. or other applicable export-control or sanctions laws.
